1 · A request is not an order
A request through the app asks us to supply parts. It does not reserve stock and it is not an accepted order. An order exists only once we confirm quantities and prices back to you. Availability shown in the app is a snapshot and can change before we confirm.
2 · Prices
Prices are quoted per unit in US dollars and are confirmed at the time we accept your order. Quoted subtotals exclude tax and delivery unless stated. Tax is calculated at invoicing. We do not apply a charge you have not been shown.
3 · Partial supply
We may confirm part of a line and hold the remainder. Held units stay on your order and you do not need to request them again. We will tell you what is confirmed and what is outstanding, line by line.
4 · Fitment
Part numbers, descriptions and supersessions are provided to help you identify a part. You are responsible for confirming a part fits your vehicle before fitting it. Where we are unsure, the app says so rather than guessing, and the counter will check with you.
5 · Delivery
We deliver to the address on the order. Risk passes on delivery, evidenced by the recipient's acknowledgement and signature. An order is complete only once every ordered unit has been dispatched and delivered. Delivery dates given by the counter are estimates unless we agree otherwise in writing.
6 · Payment
One invoice is issued per dispatched shipment. Payment is due on the terms agreed for your account. You can pay an invoice online by card or by bank debit through Stripe, and the price for paying by bank debit can be lower than the card price. A bank debit settles the balance only once it clears. A signature at delivery is proof of receipt only and is not payment. A check we have received is recorded as pending and does not settle the balance until it clears; a returned check is put back onto the balance and recorded as a separate event.
7 · Returns and cores
A part can come back within 30 days of delivery, unfitted and in its original packaging. A restocking charge of 15% applies. A core must reach us within 30 days of delivery as well. If it does not, the core charge for that part is added to a later invoice.
8 · Accounts and authority
We set accounts up at the counter and you tell us who may buy on your behalf. Anyone signed in to your account can place requests. Tell us promptly if someone should no longer have access, and we will remove it.
9 · Warranty and liability
Parts carry their manufacturer's warranty where one is given, and we will help you claim under it — ask the counter and we will tell you what covers what you bought. Beyond that, and as far as the law allows, parts bought for business use are sold without any other warranty, express or implied, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. If a part we supplied is defective, we will repair or replace it or refund the price you paid for it, at our choice, and that is the limit of our liability for it. We are not responsible for labour, towing, downtime, lost profits or other indirect or consequential losses. If you buy as a consumer, your rights under Washington law are not affected by this clause. Nothing in these terms limits any liability that the law does not allow to be limited.
10 · Governing law
These terms are governed by the laws of the State of Washington. Any dispute about them is decided in the state or federal courts located in Pierce County, Washington. Pannu Truck Parts is a trade name of Flame Freight LLC.
11 · Changes to these terms
We may change these terms by publishing a new version here with a new date. The terms in force when we accept an order are the ones that apply to it.
